ON
THE EXEMPTION FROM IMPORT DUTY ON
THE IMPORT OF RAW SUGAR BY REFINED SUGAR INDUSTRY

THE MINISTER OF FINANCE,

Considering:

a. that in the framework of boosting the growth of refined sugar industry in the country, it is deemed necessary to exempt the refined sugar industry from import duty on the import of raw sugar;

b. that based on the consideration as meant in letter a, it is deemed necessary to stipulate a decree of the Minister of Finance on the Exemption from Import Duty on the Import of Raw Sugar by refined sugar industry;

In view of:

1. Law No. 10/1995 on customs affairs;

2. Presidential Decree No. 20/P/2005;

3. Decree of the Minister of Finance No. 545/KMK.01/2003 on Stipulation of Systems of Classifications of Goods;

4. Decree of the Minister of Finance No. 547/KMK.01/2003 on Stipulation of Tariffs of Import Duty on Imported Goods;

Observing:

Letter of the Minister of Industry No. 170/M-Ind/2/2006 dated February 20, 2006;

DECIDES :

To stipulate :

THE DECREE OF THE MINISTER OF FINANCE ON THE EXEMPTION FROM IMPORT DUTY ON THE IMPORT OF RAW SUGAR BY REFINED SUGAR INDUSTRY

Article I

The exemption from import duty is granted to the refined sugar industries whose names mentioned in the attachment to this decree so that the final tariff of import duty becomes nil on the import of raw sugar with the minimum ICUMSA 1,200 I.U, subsumed into Tariff Heading/HS 1701.11.10.00.10.

Article II

To appoint Cigading Seaport-Banten as the importing place of the goods as meant in Dictum FIRST.

Article III

In the case of the raw sugar as meant in Dictum FIRST being misused, the import duty becoming due upon the import must be paid and is subjected to sanction in accordance with the provisions of legislation in force.

Article IV

The Director General of Customs and Excise further regulates the implementation of the provisions in this decree.

Article V

The decree comes into force as from the date of stipulation and is effective for 6 (six) months as from the date of stipulation.
