a. that in the framework of improve institutions of Special Economic Zones that covers National Council Secretariat, Zone Council, Zone Council Secretariat, and Administrator in the implementation of duties and function, it is necessary to amend provisions in Presidential Regulation Number 33 of 2010 concerning National Council and Zone Council of Special Economic Zones;
b. that based on consideration as intended in paragraph a, it is necessary to stipulate Presidential Regulation concerning Amendment to Presidential Regulation Number 33 of 2010 concerning National Council and Zone Council of Special Economic Zones;
1. Article 4 paragraph (1) of the Constitution of the Republic of Indonesia of 1945;
2. Law Number 17 of 2003 concerning State Finance (Statute Book of the Republic of Indonesia Number 47 of 2003, Supplement to Statute Book of the Republic of Indonesia Number 4286);
3. Law Number 1 of 2004 concerning State Treasury (Statute Book of the Republic of Indonesia Number 5 of 2004, Supplement to Statute Book of the Republic of Indonesia Number 4355);
4. Law Number 32 of 2004 concerning Regional Administration (Statute Book of the Republic of Indonesia Number 125 of 2004, Supplement to Statute Book of the Republic of Indonesia Number 4437) as amended by Law Number 12 of 2008 (Statute Book of the Republic of Indonesia Number 59 of 2008, Supplement to Statute Book of the Republic of Indonesia Number 4844);
5. Law Number 39 of 2009 concerning Special Economic Zones (Statute Book of the Republic of Indonesia Number 147 of 2009, Supplement to Statute Book of the Republic of Indonesia Number 5066);
6. Government Regulation Number 41 of 2007 concerning the Regional Administrator Organization (Statute Book of Republic of Indonesia Number 89 of 2007, Supplement to Statute Book of Republic of Indonesia Number 4741);
7. Government Regulation Number 2 of 2011 concerning Management of Special Economic Zones (Statute Book of the Republic of Indonesia Number 3 of 2011, Supplement to Statute Book of the Republic of Indonesia Number 5186);
8. Presidential Regulation Number 33 of 2010 concerning National Council and Zone Council of Special Economic Zones;
PRESIDENTIAL REGULATION CONCERNING AMENDMENT TO THE PRESIDENTIAL REGULATION NUMBER 33 OF 2010 CONCERNING NATIONAL COUNCIL AND ZONE COUNCIL OF SPECIAL ECONOMIC ZONES
Several provisions in Presidential Regulation Number 33 of 2010 concerning National Council and Zone Council of Special Economic Zones, shall be amended as follows:
1. Provision of paragraphs (1), (3) and (4) of Article 11 shall be amended, so Article 11 becomes as follows:
"(1) PNS is placed on the Secretariat of the National Council has hired status.
(2) PNS as intended in paragraph (1) is dismissed from organic position in his/her parent agency.
(3) The process of PNS ranking as intended in paragraph (1), carried out by the parent agency in accordance with regulation in the field of employment.
(4) PNS as intended in paragraph (1), honorably dismissed as a PNS when has reach the limit of retirement age and is given appropriate employment rights in accordance with regulation in the field of employment."
2. Provision of Article 20 shall be amended, so Article 20 becomes as follows:
"Article 20
(1) Organizational Structure of Zone Council consists of the Head it is the Governor, the Vice Head it is the regent/mayor in KEK area, and Members.
(2) Members of Zone Council as intended in paragraph (1), consisting of maximum 9 (nine) persons, they are:
3. Provision of Article 24 paragraph (1) shall be amended, and between paragraph (1) and paragraph (2) is inserted 1 (one) paragraph, called Paragraph (1a), so Article 24 becomes as follows:
"Article 24
(1) The secretariat of Zone Council is held by working unit of province officials who have field of duties match with KEK duties and function.
(1a) Appointment of working unit of province officials as intended in paragraph (1) shall be determined by Governor.
(2) Secretariat of Zone Council is led by a Secretary who has responsibility in implement duties to the Head of Zone Council."
4. Provisions of Article 29 shall be amended, so Article 29 become as follows:
"Article 29
(1) Administrator as intended in Article 28 paragraph (1) is determined by establishment of regional official working unit or determination of existing regional official working unit.
(2) Establishment of regional official working unit as intended in paragraph (1) by considering scope of duties, financing, and human resources.
(3) Existing regional official working unit as intended in paragraph (1) is regional official working unit that has field of duties matching with implementation of single window integrated services in the field of investment."
5. Provisions in Article 30 shall be supplemented paragraph (2), so Article 20 become as follows:
"Article 30
(1) Administrator of Zone Council has duties to assist in:
(2) Control of KEK operations as intended in paragraph (1) b in the form of checking services from Management Board to Businesses in according with service standards."
6. Provision of Article 31 paragraphs (2), (3) and (4) shall be amended, so Article 31 becomes as follows:
"Article 31
(1) Administrator is led by a Head of Administrator from PNS.
(2) The administrator shall consist of:
(3) Provisions on the echelon level of organization unit in the Administrator environment is determined in accordance with regulation in the field of regional officials institutions.
(4) Administrator that is established as intended in Article 28 paragraph (1) is determined as regional officials working unit by the Governor in case of KEK is inter regencies/municipalities, or by Regent/Mayor in case of KEK is in regency/ municipality."
7. Provision of Article 32 shall be amended, so Article 32 become as follows:
"Article 32
Personnel of Administrator as intended in Article 31 paragraph (3) are from the PNS elements."
This Presidential Regulation shall come into force on the date of stipulation.
For public cognizance, this Presidential Regulation shall be promulgated by placing it in the State Gazette of the Republic of Indonesia.
