CIRCULAR OF THE DIRECTOR GENERAL OF CUSTOMS AND EXCISE

CONCERNING
CUSTOMS PROCEDURES ON THE ENTRY AND RELEASE OF YACHTS IN THE FRAMEWORK SAIL WAKATOBI-BELITONG 2011

A. General

In accordance with Presidential Decree No. 9 of 2011 concerning the National Organizing Committee of Sail Wakatobi - Belitong 2011 where the Director General of Customs and Excise as Vice Chairman of the Port, Customs, Quarantine, and Immigration Section, it is necessary to publish a technical guide on customs procedures for the entry and release yachts in the framework of Sail Wakatobi-Belitong 2011 that Sail Wakatobi Belitong 2011 will be held in the Southeast Sulawesi Province and Bangka Belitung Islands Province.

B. Purpose and Objectives

1. To provide facilitation on service and supervision on yachts that follows the activities of Sail Wakatobi - Belitong 2011; and

2. As a technical guide on customs procedures on the entry and release yachts in the framework of Sail Wakatobi - Belitong 2011.

C. Scope

This Circular covers only customs procedures on the entry and release yachts in the framework of Sail Wakatobi - Belitong 2011.

D. Basic

This Circular is stipulated based on:

• 1. Presidential Decree Number 9 of 2011 concerning National Organizing Committee of Sail Wakatobi - Belitong 2011;
• 2. Regulation of the Minister of Finance Number 140/PMK.04/2007 concerning Temporary Import.

E. Customs Procedures on the Entry And Release Yachts in the Framework of Sail Wakatobi-Belitong 2011

1. Implementation Technical Team

In the framework to implement facilitation of service and supervision on the yachts that take part in Sail Wakatobi - Belitong 2011 activities, the Director General established the Implementation Technical Team for Sail Wakatobi - Belitong 2011 that is led by Director of Customs Technical based on Decree of the Director General.

2. Port of Entry and Release

2.1. Sea ports are stipulated as ports of entry and also ports of release are:

• a. Saumlaki Port;
• b. Ambon Port;
• c. Kupang Port;
• d. Bali Port;
• e. Wakatobi Port;
• f. Belitung Port;
• g. Batam Port;
• h. Tarakan Port;
• i. Jakarta Port;
• j. Kumai Port.

2.2. In case of entry and release in other port than as intended in paragraph (1), yacht rally participants must report to the nearest Customs Office or Integrated Post of Sail Wakatobi-Belitong 2011 in the port of destination.

3. Temporary Import of Yachts

3.1. Category of Temporary Import of Yachts.

On the entry of yachts in the framework of Sail Wakatobi-Belitong 2011 granted temporary import permit with get exemption of import duty.

3.2. Application to obtain Temporary Import Permit

To obtain a temporary import permit, the Director General of Supervision and Control of Marine and Fisheries Resources (P2SDKP) Ministry of Marine and Fisheries as Chairman of the Organizing Committee of Sail Wakatobi - Belitong 2011 applies for a temporary import permit to the Director General of Customs and Excise.

3.3. Guarantee

• a. Director General of Supervision and Control of Marine and Fisheries Resources (P2SDKP) Ministry of Marine and Fisheries as Chairman of the Organizing Committee of Sail Wakatobi - Belitong 2011 as a guarantor for the writing guarantee to the temporary import permit of yachts in the framework of Sail Wakatobi-Belitong 2011.
• b. Written guarantee as intended above be centralized in the Director General.

3.4. Period

Period of temporary import permit of yachts in the framework of Sail Wakatobi - Belitong 2011 provided for a period up to December 31, 2011.

4. Customs Obligation

4.1. Customs Documents

To simplify and speed of service, the Customs Office or Technical Implementation Team of Sail Wakatobi - Belitong 2011 prepare the necessary customs documents.

4.2. Entry of Yachts

• i. Notification of Imported Goods (PIB)
• a. At the time of entry, Captain (Skipper) of yacht for Sail Wakatobi-Belitong 2011 must submit Notification of Imported Goods (PIB), a copy of a temporary import permit, and Inward Manifest in the ports of entry that have been stipulated.
• b. Process of yachts entry by using PIB and Inward manifest manually.
• ii. Supporting Documents
• In addition to customs complementary documents, Captain (Skipper) of yacht for Sail Wakatobi - Belitong 2011 or his/her proxy is required to submit documents about the identity and technical specifications of the ship (e.g. Ship's Particular or such documents).
• iii. Physical Examination
• Based on yacht data from the attached supporting documents, Customs and Excise Officers can perform a physical examination on the yacht.

4.3. Release of Yachts

• i. Notification of Exported Goods (PEB)
• a. Before yacht is released from customs area, Captain (Skipper) of yacht for Sail Wakatobi - Belitong 2011 or his/her proxy shall file Notification of Export Goods (PEB) at the stipulated port equipped with the Outward Manifest for overseas destinations.
• b. Settlement of releasing yacht by using PEB and Outward manifest manually.
• ii. The Shelter Port
• In case of yacht will go through several ports, in the Outward Manifest listed the names of ports that will be visited and the Captain (Skipper) of yacht for Sail Wakatobi - Belitong 2011 or his/her proxy give Outward Manifest for overseas destinations to the Head of Customs Office that oversees the last stop port before go overseas.

5. Basic Value for Calculation of Import Duty (NDPBM)

Basic Value for Calculation of Import Duty (NDPBM) contained in PIB and PEB documents in the framework of Sail Belitong-Wakatobi 2011 is set at Rp. 9000.00 per 1 U.S. Dollar.

6. Non-Tax State Levy (PNBP)

Payments of PNBP for every customs service in the framework of Sail Wakatobi - Belitong 2011 charged to the budget of the Directorate General of Supervision and Control of Marine and Fisheries Resources (P2SDKP) Ministry of Marine and Fisheries.

7. Sanctions

• 1. Temporary Import permit of yachts based on this Circular is only used in the framework of Sail Wakatobi - Belitong 2011 and should be released from Indonesia customs area before the temporary import permit expires.
• 2. In case yacht is not released from the customs area after a period of temporary import permit expired and/or used for other than Sail Wakatobi - Belitong 2011 activities will be penalized according to the provisions in force.

This is to be implemented with the full sense of responsibility
