a. that in the framework of national economics reform and to make fair business as well as support efficient trading, it is necessary to give opportunity to Foreign Company in Production Field to do activities as General Importer.
b. that in relation with above think, it is necessary to amend Decree of the Minister of Trade No. 77/Kp/III/78 concerning Limited Trading Activities for Production Companies in the Framework of Investment;
1. Law No. 10/1995 concerning Customs (Statute Book No. 75/1995, Supplement to Statute Book No. 3612);
2. Government Regulation No. 2/1996 concerning Activities of Companies that are Established in the Framework of Foreign Investment in the Export and Import Field (Statute Book No. 31/1996, Supplement to Statute Book No. 3620) as amended several times, the latest by Government Regulation No. 46/1998 (Statute Book No. 75/1998, Supplement to Statute Book No. 3756);
3. Decree of the Minister of Trade No. 1460/Kp/XII/84 concerning Importer's Identity No. (API);
4. Decree of the Minister of Industry and Trade No. 228/MPP/Kep/7/97 concerning General Provision in the Export Field;
5. Decree of the Minister of Industry and Trade No. 229/MPP/Kep/7/97 concerning General Provision in the Import Field;
6. Decree of the Minister of Industry and Trade No. 230/MPP/Kep/7/97 concerning Goods Subject to the Import Trading System;
7. Decree of the Ministry of Industry and Trade No. 408/MPP/Kep/10/97 concerning Provision and Procedure to Issue Trading Business Registration (TDUP) and Trading Business License (SIUP);
8. Decree of the Minister of Industry and Trade No. 12/MPP/Kep/I/1998 concerning Company Registration Obligatory Organization;
REGULATION OF THE MINISTER OF INDUSTRY AND TRADE CONCERNING AMENDMENT TO THE DECREE OF THE MINISTER OF TRADE No. 77/Kp/III/78 CONCERNING LIMITED TRADING ACTIVITIES FOR PRODUCTION COMPANIES IN THE FRAMEWORK OF INVESTMENT
To amend several provision in Decree of the Minister of Trade No. 77/Kp/III/78 concerning Limited Trading Activities for Production Companies in the Framework of Investment, as follows:
1. Provision of Article 1 shall be amended, so wholly read as follows:
"Article 1
Foreign company in production that is established in the framework of Law No. 1/1967 concerning Foreign Investment can:
(a) import machines, spare parts, building materials/equipment and raw materials/auxiliary materials f to be used in its production process.
(b) buy machines, spare parts, building materials/equipment and raw materials/auxiliary materials from domestic market to be used in its production process.
(c) General Exporter and Importer activities.
(d) do promotion, market research and control marketing of its production."
2. Provision of Article 3 paragraph (a) shall be amended, so wholly read as follows:
"Article 3
(a) 1. Companies as intended in Article 1 to conduct import of machines, spare parts, building materials/equipment and raw materials/auxiliary materials to be used in its production process is obligate to have Limited Importer's Identity Number (APIT).
2. Limited Importer's Identity Number (APIT) as intended in paragraph (1) shall be pretended as General Importer's Identity Number (APIU)."
By enforcement of this Decree, all other provisions in Decree of the Minister of Trade No. 77/Kp/III/78 shall be declared null.
This Decree shall come into force on the stipulation date.
For public cognizance, this Decree shall be published by placing it in the State Gazette of the Republic of Indonesia.
