CONCERNING
DETERMINATION OF IMPORT DUTY RATE IN THE FRAMEWORK OF PREFERENTIAL TRADE AGREEMENT BETWEEN THE GOVERNMENT OF THE REPUBLIC OF INDONESIA AND GOVERNMENT OF THE ISLAMIC REPUBLIC OF PAKISTAN

Attachment

Considering:

a. that based on Presidential Regulation Number 98 of 2012 concerning Ratification of Preferential Trade Agreement between the Government of the Republic of Indonesia and the Government of the Islamic Republic of Pakistan, Government of the Republic of Indonesia already ratified Preferential Trade Agreement between the Government of the Republic of Indonesia and the Government of the Islamic Republic of Pakistan;

b. that Minister of Trade through letter Number 2108/M-DAG/SD/II/2012 dated November 30, 2012 with subject Request for Issuance of Regulation of the Minister of Finance in the framework of Implementation of Preferential Trade Agreement between the Government of the Republic of Indonesia and the Government of the Islamic Republic of Pakistan; has apply request to the Minister of Finance to issues Regulation of the Minister of Finance in the framework of Implementation of Preferential Trade Agreement between the Government of the Republic of Indonesia and the Government of the Islamic Republic of Pakistan;

c. that based on consideration as intended in paragraphs a and b above, and in the framework to implement provisions in Article 13 paragraph (2) and Article 14 paragraph (2) of Law Number 10 of 1995 concerning Customs as amended by Law Number 17 of 2006, it is necessary to stipulate Regulation of the Minister of Finance concerning Determination of Import Duty Rate in the Framework of Preferential Trade Agreement between the Government of the Republic of Indonesia and the Government of the Islamic Republic of Pakistan.

In view of:

1. Law Number 7 of 1994 concerning Ratification of Agreement Establishing The World Trade Organization (Statute Book of the Republic of Indonesia Number 57 of 1994, Supplement to Statute Book of the Republic of Indonesia Number 3564);

2. Law Number 10 of 1995 concerning Customs (Statute Book of the Republic of Indonesia Number 75 of 1995, Supplement to Statute Book of the Republic of Indonesia Number 3612) as amended by Law Number 17 of 2006 (Statute Book of the Republic of Indonesia Number 93 of 2006, Supplement to Statute Book of the Republic of Indonesia Number 4661);

3. Presidential Regulation Number 98 of 2012 concerning Ratification of Preferential Trade Agreement between the Government of the Republic of Indonesia and the Government of the Islamic Republic of Pakistan;

4. Regulation of the Minister of Finance Number 213/PMK.011/2011 concerning Stipulation of Goods Classifying System and Charging of Import Duty on the Imported Goods;

DECIDES:

To stipulate:

REGULATION OF THE MINISTER OF FINANCE CONCERNING DETERMINATION OF IMPORT DUTY RATE IN THE FRAMEWORK OF PREFERENTIAL TRADE AGREEMENT BETWEEN THE GOVERNMENT OF THE REPUBLIC OF INDONESIA AND GOVERNMENT OF THE ISLAMIC REPUBLIC OF PAKISTAN.

Article 1

To determine rate of import duty on the imported goods from Pakistan in the framework of implementation of Preferential Trade Agreement between the Government of the Republic of Indonesia and Government of the Islamic Republic of Pakistan as listed in Attachment that is an integral part of this Ministerial Regulation.

Article 2

Imposition of import duty based on determination of import duty rate as intended in Article 1, shall be implemented with following provisions:

• a. import duty rate in the framework of Preferential Trade Agreement between the Government of the Republic of Indonesia and Government of the Islamic Republic of Pakistan less than general import duty rate only be charged to imported goods that has Certificate of Origin (Form IP) already signed by official in duty in Pakistan;
• b. Importer should attach Certificate of Origin (Form IP) reference number as intended in paragraph a and facility code in the framework of Preferential Trade Agreement between the Government of the Republic of Indonesia and Government of the Islamic Republic of Pakistan at the Declaration of imported goods;
• c. Original of Certificate of Origin (Form D) in the framework of Preferential Trade Agreement between the Government of the Republic of Indonesia and Government of the Islamic Republic of Pakistan as intended in paragraph a, shall be submitted by the importer when submitted declaration of imported goods as intended in paragraph b, at Customs Office of entry port; and
• d. in case of general import duty rate is less than import duty rate in the framework of Preferential Trade Agreement between the Government of the Republic of Indonesia and Government of the Islamic Republic of Pakistan as listed in Attachment of this Ministerial Regulation general import duty rate is applied.

Article 3

Provisions in this Ministerial Regulation is effective to the imported goods that import customs notification documents got registration number from Customs Office of entry port.

Article 4

This Ministerial Regulation shall come into force on January 18, 2013.

For public cognizance, this Ministerial Regulation shall be promulgated by placing it in the State Gazette of the Republic of Indonesia.
