CONCERNING
AMENDMENT TO THE REGULATION OF THE MINISTER OF FINANCE No. 124/PMK.04/2007 CONCERNING REGISTRATION OF IMPORTERS

BY THE GRACE OF ALMIGHTY GOD
THE MINISTER OF FINANCE,

Considering:

a. that in the framework to support effectively importers registration through electronic media, it is necessary to improve provision on the registration of importers as governed by Regulation of the Minister of Finance No. 124/PMK.04/2007 concerning Registration of Importers;

b. that based on consideration as intended in paragraph a above, it is necessary to stipulate Regulation of the Minister of Finance concerning Amendment to the Regulation of the Minister of Finance No. 124/PMK.04/2007 concerning Registration of Importers;

In view of:

1. Law No. 10/1995 concerning Customs (Statute Book No. 75/1995, Supplement to Statute Book No. 3612) as amended by Law No. 17/2006 (Statute Book No. 93/2006, Supplement to Statute Book No. 4661);

2. President Decree No. 20/P/2005;

3. Regulation of the Minister of Finance No. 124/PMK.04/2007 concerning Registration of Importers;

DECIDES:

To Stipulate:

REGULATION OF THE MINISTER OF FINANCE CONCERNING AMENDMENT TO THE REGULATION OF THE MINISTER OF FINANCE No. 124/PMK.04/2007 CONCERNING REGISTRATION OF IMPORTERS

Article I

Several Provision on the Regulation of the Minister of Finance No. 124/PMK.04/2007 concerning Registration of Importers shall be amended as follows:

Provision of Article 2 paragraph (3) shall be amended, so Article 2 is read as follows:

"Article 2

(1) To be able to fulfill customs obligation, importers shall register with the Directorate General of Customs and Excise.

(2) To register with the Directorate General as intended in paragraph (1) importers shall file an application to the Director General through the electronic media.

(3) The application as intended in paragraph (2) shall be made by filling the form as provided for in the Regulation of the Director General."

2. Provisions in Article 5 paragraph (2) shall be amended so Article 5 is read as follows:

"Article 5

(1) The Director General can accept or reject an application for the registration of importer in 30 (thirty) work days after receiving the application form as intended in Article 2 paragraph (3) in a complete and accurate manner.

(2) If the application for the registration of importer is accepted, the Director General shall issue NIK delivered in a notice of registration using the format set forth in the Regulation of the Director General.

(3) If the application for the registration of importer is rejected, the Director General shall notify the importer of the rejection by providing reasons for the rejection through the electronic media.

(4) NIK as intended in paragraph (2) is valid at all customs offices."

3. Attachments I and II shall be demolished.

Article II

This Regulation of the Minister of Finance shall come into force as from December 31, 2008.

For public cognizance, this Regulation of the Minister of Finance shall be published by placing it in the State Gazette of the Republic of Indonesia.
