GENERAL PROVISIONS MAKING TRADING AGREEMENT (SPJB) BETWEEN SUBSIDIZED FERTILIZER PRODUCER WITH THE DISTRIBUTOR

1. Trading Agreement (SPJB) of Subsidized Fertilizer between Distributor Producer with made for a period of 1 (one) year. The extension of the contract can be implemented, if, according to the assessment that the Distributor Producers showed good performance.

2. Basically allocation of Subsidized Fertilizer from Producers to Distributors that will be stipulated in SPJB of Subsidized Fertilizer be guided by a plan of Subsidized Fertilizer in areas which are the responsibility of each producer with respect to the allocation of Subsidized Fertilizer stipulated by the Minister of Agriculture.

3. In SPJB set the price of fertilizer from the Producer to the Distributor and the highest fertilizer prices from Distributors to Retailers.

4. In SPJB stipulated area of responsibility of the distribution of Subsidized Fertilizer Distributor stating Regency/City and/or the District that are in the location areas of responsibility Producers concerned.

5. The allocation of fertilizer distribution for 1 (one) year period in accordance in SPJB mentioned in detail in the monthly allocation for each type of fertilizer.

6. SPJB Subsidized Fertilizer Distributor must include sanctions for violating the provisions of the prevailing distribution of Subsidized Fertilizer.

7. Inclusion of sanctions provisions in the SPJB between Producers with Distributors may include written warnings, suspension of Subsidized Fertilizer allocation and/or termination of employment with the relevant Distributor.

8. Form or format of SPJB made in accordance with generally accepted provisions in any treaty making.

GENERAL PROVISIONS MAKING TRADING AGREEMENT (SPJB) BETWEEN FERTILIZER DISTRIBUTOR WITH THE FERTILIZER RETAILER

1. Trading Agreement (SPJB) of Subsidized Fertilizer between Distributor with Retailers is made for a period of 1 (one) year. The extension of the contract can be implemented, if based on Distributor assessment, the Retailer showed good performance.

2. Basically allocation of Subsidized Fertilizer from Distributor to Retailers that will be stipulated in SPJB of Subsidized Fertilizer be guided by a plan of Subsidized Fertilizer demand in areas which are the responsibility of each Distributor with respect to the allocation of Subsidized Fertilizer stipulated by the Producer.

3. In SPJB stipulated price of fertilizer from the Distributor to the Retailer as well as collateral and obligation of Retailer to sell Subsidized Fertilizer in cash to the Farmer and/or Farmer Group in Retailer warehouse accordance HET in packing of 50 kg or 40 kg or 20 kg.

4. In SPJB stipulated area of responsibility of the distribution of Subsidized Fertilizer from Retailers by mentioning the District and/or the Village that are in the location area of responsibility is concerned Distributors.

5. The allocation of fertilizer for 1 (one) year period in accordance SPJB mentioned in detail in the monthly allocation for each type of fertilizer.

6. SPJB Subsidized Fertilizer Retailers must include sanctions for violating the provisions of the prevailing distribution of Subsidized Fertilizer.

7. Inclusion of provisions in the sanctions SPJB between Distributors with Retailers may include written warnings, suspension, allocation of Subsidized Fertilizer and/or termination of employment with the Retailer concerned.

8. Form or format SPJB shall be made in accordance with generally accepted provisions in any treaty making.
